Supplier Qualification Confirmation Report

The manufacturer or importer of a product requiring supplier conformance confirmation shall conduct product testing for each model before releasing the product into the market or going through customs clearance or have a third party conduct such a test to voluntarily confirm the safety of the product as per the safety standard. In such a case, the manufacturer or importer of the product shall prepare a supplier conformance confirmation test report or a supplier conformance certificate.

The products requiring supplier conformance confirmation

  • The products requiring supplier conformance confirmation mean the electrical appliances or consumer products listed below;
  • A. The electrical appliances requiring supplier conformance confirmation: the electrical appliances that involve risks of fires or electrification due to their structures or the way they are used and designated by the Decree of the Ministry of Trade, Industry, and Energy, as it is recognized that a test in an agency designated by the Minister of the said Ministry may prevent such risks;
  • B. The consumer products requiring supplier conformance confirmation: the consumer products that involve risks of fires or electrification due to their structures or the way they are used and designated by the Decree of the Ministry of Trade, Industry, and Energy, as it is recognized that a test in an agency designated by the Minister of the said Ministry may prevent such risks;

The related laws and regulations

(Article 3 of the Enforcement Rules (The scope of the products subject to the safety management requirements)
  • ⑤ The electrical appliances that require supplier conformance confirmation are designated as the products which use an AC/DC power source of 1,000 V or less, as shown in Item 1 of Table 5.
  • ⑥ The consumer products that require supplier conformance confirmation shall be the products shown in Item 2 under Table 5.

  • ① The details of the items that are designated as the electrical products that require safety certifications, electrical products of which the safety must be confirmed, and electrical products of which the conformity of the supplier must be confirmed (hereinafter referred to as the electrical products that require safety management), as per Item 8 under Article 3 of the rule, are as follows;
  • 3. The detailed items of the electrical appliances requiring supplier conformance confirmation are as follows;
  • ② The details of the household products, as per Item 8, Article 3 of the rule, that require safety certification, safety confirmation, and confirmation of the conformity of the supplier, as well as the household products that require the packaging to protect the children (hereinafter referred to as the household products that require safety management) are as follows;
  • 3. The detailed items of the consumer products requiring supplier conformance confirmation are as follows;
  • ③ The electrical products that use an AC power source of 30V or less or a DC source of 42V or less are not counted as electrical products that require safety management. However, even if the product has a power source of AC 30V or less or DC 42 or less, the electrical products that are separately designated in Table 1 through 3 are counted as electrical products that require safety management.
  • ④ The electrical products that combine more than two product functions into one are considered as a single model, to which the detailed criteria for model classification for their functions before the combination and safety have a direct impact.

  • 1. The items of custom designs installed in automobiles, trains, ships, or aircraft are not electrical appliances requiring supplier conformance confirmation. However, the GPS in Paragraph AC under Item 10 or those of a structure that is to be used at homes, offices, farms, small-sized manufacturing facilities, or places of commerce do not count as electrical appliances requiring supplier conformance confirmation.
  • 2. However, those that are designed to use primary batteries (non-rechargeable) or secondary batteries (rechargeable) as a power source are not electrical appliances requiring supplier conformance confirmation. However, the electric insect killing machines using a DC power source in Paragraph AG under Item 7, Table 2, will count as the electrical appliances requiring supplier conformance confirmation if they use primary batteries (non-rechargeable) or secondary batteries (rechargeable) as the sole source of power.

Furnishing the documents related to the products requiring supplier conformance confirmation

According to Item 4 under Article 23 of the law (Supplier Conformance Confirmation, etc.), the manufacturer or importer of a product requiring supplier conformance confirmation shall furnish the documents that demonstrate the conformance of the products requiring supplier conformance confirmation meet safety standards.

Article 18 of the ELECTRICAL APPLIANCES AND CONSUMER PRODUCTS SAFETY CONTROL ACT (Markings on the products subject to safety confirmation requirements)
  • ① A manufacturer or importer of a product to be confirmed for its safety shall, in accordance with the Decree of the Ministry of Trade, Industry, and Energy, make the following marking on the products to be confirmed for safety or on their packages (hereinafter referred to as the 'safety confirmation markings, etc.')
    1. The products subject to safety confirmation requirements that completed safety confirmation reporting: The markings of safety confirmation and other markings as per the safety standard in Item 3, Article 15
    2. The products subject to safety confirmation requirements that have been exempted of the duty for safety confirmation reporting as per Article 16: The markings indicating the exemption of safety confirmation reporting
    3. The electrical appliances subject to safety confirmation that have been tested for their safety in accordance with Item 1, Article 17: The markings as designated by the standard for safety tests in Item 2, Article 17.
  • ② A person who fails to comply with the duty of safety confirmation reporting; failed to get the exemption for safety confirmation reporting; or those that did not get the safety test as per Item 1, Article 17 shall not make indications of safety confirmation or other similar indications on the products subject to safety confirmation requirements or their packages.
  • ③ A party that falls into any of the following conditions shall not make changes or remove the safety confirmation markings on the products subject to the safety confirmation requirements.
    1. The manufacturer, importer, or importation agents of the products subject to the safety confirmation requirements
    2. The retailer, broker, or procurement agents for the products subject to the safety confirmation requirements
    3. The renter of the products subject to the safety confirmation requirements
    4. A manufacturer of a product that uses the products subject to the safety confirmation requirements as its parts or components
    5. A party that uses the electrical appliances subject to the safety confirmation requirements and falls into any of the following conditions;
    1. A. An electrical business as per Item 2, Article 2 of the ELECTRIC UTILITY ACT
    2. B. An installer of off-grid electrical equipment as per Item 19, Article 2 of the ELECTRIC UTILITY ACT
    3. C. An installer as per Item 3, Article 2 of the ELECTRICAL CONSTRUCTION BUSINESS ACT
    6. A person that uses the consumer products subject to the safety confirmation requirements for its business
  • ④ If a party that falls into any of the paragraphs under Item 3 wishes to sell, lend, or broker the sales of the products subject to the safety confirmation requirements via the Internet (unless the broker of on-line sales in accordance with the ACT ON THE CONSUMER PROTECTION IN ELECTRONIC COMMERCE, ETC. removes the products without safety certification markings, etc. from the cyber-mall it runs and the selling client of the brokerage service is ordered by the broker to input the information including the safety confirmation markings when registering a new product, while it is possible for the consumers can verify such information by means of technical measures in place,) wishes to act on behalf of the seller to purchase or import, it shall post the information related to safety confirmation in its website as per the Decree of the Ministry of Trade, Industry, and Energy.
Article 35 of the Enforcement Rules of ELECTRICAL APPLIANCES AND CONSUMER PRODUCTS SAFETY CONTROL ACT (Markings on the products subject to safety confirmation requirements)
  • ① The method of making indications as per each paragraph under Item 1, Article 18 of the law (hereinafter referred to as the safety confirmation markings, etc.) is as shown in Table 8.
  • ② The safety confirmation markings, etc., shall be placed before the shipping of the products that are manufactured in South Korea. For the items that are manufactured in a foreign country and imported into South Korea, the marks shall be placed before customs clearance.
  • ③ Any of the parties, as per any of the paragraphs under Item 3, Article 18 of the law shall post the information related to safety confirmation for each of the following items as per Item 4 under Article 18 of the law on their website.
    1. A symbol as per Paragraph A, Item 1 under Table 8
    2. The safety confirmation reporting number, name of the product, the model name (if there is a model name), name of the manufacturer, or the importer's name

01. How to place the markings for safety certification, safety confirmation reporting, supplier qualification, and child protection packaging.

B. How to place the marks
  • The sizes of the symbols of the safety certification, safety verification reporting, and child protection packaging (hereinafter referred to as the safety certifications, etc. shall be adjusted according to the size of the products subject to safety management. However, the ratio between the width and height of the marks are as shown in Paragraph A.
  • The safety certifications etc. must be placed on the products subject to safety management so that the marks are easily noticeable. These marks are also to be printed, engraved, or placed by other means to ensure that they do not fell off or get erased, etc.
  • The information on the marking method of the safety certifications, etc., information on safety standards, and other information as designated by the Head of KATS must be indicated in Korean. However, for electrical appliances, it is possible to make markings using Korean and alphabets, etc., in parallel.
  • The color of the safety certifications, etc. shall be, as a principle, black and maybe supplemented with other colors.
  • If it is difficult to make safety certification markings, or for the products that are purchased in bulk by the users without being resold into the market, it is allowed to make the markings on the smallest packaging unit of such a product, instead of every single piece of such a product.
  • The details of the markings and indications shall be in accordance with the announcement by the Head of KATS.
02. The indications of the exemption confirmation of the safety certifications, etc.
  • The exemption confirmation markings for the safety certifications etc. shall be placed on the surface of the eligible product.
  • The exemption confirmation markings of the safety certifications etc. shall be made using the symbols of safety certifications, etc., with a text 'Exemption Confirmed' beneath the symbol.
  • If it is not possible to place the exemption confirmation marks on the product because the product is for exportation, too small, or to be used as a part or a component, document the reason and attach the exemption confirmation slip on the related document, which shall then be preserved.
03. How to make the safety test marks of electrical appliances that are imported and previously owned.
  • The safety test marking of the imported, second-hand electrical appliances must be attached to the product itself.
  • The markings for safety testing of imported and second-hand electrical appliances shall be based on the symbols used for safety certifications, etc., and, in accordance with the procedures designated by the Head of KATS, a text that goes 'Safety Tested' and the unique identification number for the product must be indicated beneath the symbol.

  • Rated voltage
  • The name of the manufacturer and the importer (if a foreign company, add the country of origin, as well.)
  • An indication of the time of manufacture of the product
    (ex: Year and month of manufacture, lot number, or other indications of such time by the manufacturer)
  • Contact information for after-sales services (which must be a contact number in South Korea that the customers can use to actually receive such services, in South Korea)
  • The required indications and precautions for other specific safety standards
