Children protection packaging marking

"Child protection packaging" is a type of packaging or container that is designed to make it difficult for children under five to take out the contents within a certain amount of time, while it is not too difficult for adults to open the package.

Article 3 of the Enforcement Rules of the ELECTRICAL APPLIANCES AND CONSUMER PRODUCTS SAFETY CONTROL ACT (The scope of the products subject to the safety management requirements)
  • ① The manufacturer or importer of consumer products requiring child protection packaging shall, when submitting a report as per Item 2, Article 27, place a mark the consumer product requiring child protection packaging or its packaging to show that the product/packaging employs child protection packaging (hereinafter referred to as the child protection packaging marking).
    1. Those that are manufactured or imported for the purpose of being sold to a manufacturing business.
    2. Those that are manufactured or imported for the purpose of R&D or exportation.
  • ② The manufacturer or importer of consumer products requiring child protection packaging shall, if it used a child protection packaging as per the text in Item 1, report such to the Minister of Trade, Industry, and Energy for each model of the products requiring child protection packaging. The same shall apply when it wishes to make a change with the said packaging.
  • ③ The Minister of Trade, Industry, and Energy shall determine and announce the safety standard to be applied to the consumer products requiring child protection packaging.
Article 47 (Reporting of the consumer products requiring child protection packaging), the Enforcement Rules of the ELECTRICAL APPLIANCES AND CONSUMER PRODUCTS SAFETY CONTROL ACT.
  • ① According to Item 2, Article 28 of the law, if a manufacturer or importer wishes to report that it used child protection packaging, shall submit a report along with the following documents to a safety certification body, as per the form No. 20 Child Protection Packaging Report, for each model of such products before the shipping or customs clearance of the said products.
    1. A copy of the business registration certificate or equivalent documents (if there is more than one factory that manufactures the same product, the document shall be submitted for each of these factories.)
    2. A product manual for the child protection packaging
    3. Documents that confirm the use of child protection packaging
  • ② The safety certification body that received the said report in Item 1 shall issue a child protection packaging reporting certificate as per Form No. 20.
Article 48 (Reporting of the changes with the report of child protection packaging), the Enforcement Rules of the ELECTRICAL APPLIANCES AND CONSUMER PRODUCTS SAFETY CONTROL ACT.
  • ① According to the provisions under Item 2, Article 28 of the law, a manufacturer or importer that wishes to change the content of the child protection packaging report shall submit a change report for child protection packaging as per Form No. 21, along with documentary evidence, to a safety certification body.
  • ② (2) A safety certification body that received the said change report in Item 1 above shall issue a new child protection packaging change reporting certificate to the reporting party, as per Form 21.
Article 30 (No sales), the ELECTRICAL APPLIANCES AND CONSUMER PRODUCTS SAFETY CONTROL ACT

A manufacturer or importer of the consumer products requiring child protection packaging shall not sell, import, display, or store the consumer products requiring child protection packaging that lack the mark of child protection packaging.

Consumer products requiring child protection packaging

A consumer product requiring child protection packaging refers to the consumer products with risks of inhalation toxicity or ingestion toxicity that require child protection packaging as per the decree by the Ministry of Trade, Industry, and Energy.

Children protection packaging marking

Article 29 (Marking of child protection packaging), the ELECTRICAL APPLIANCES AND CONSUMER PRODUCTS SAFETY CONTROL ACT
  • ① The manufacturer or importer of consumer products requiring child protection packaging shall, when submitting a report as per Item 2, Article 27, place a mark the consumer product requiring child protection packaging or its packaging to show that the product/packaging employs child protection packaging (hereinafter referred to as the child protection packaging marking).
  • ② A consumer product requiring child protection packaging or child protection packaging that did not complete the reporting process as per Item 2, Article 28 shall not be allowed to bear a child protection packaging mark or other similar marks.
Article 49 (Marking of child protection packaging), the ELECTRICAL APPLIANCES AND CONSUMER PRODUCTS SAFETY CONTROL ACT
  • ① The marking method of the showing product/packaging employs child protection packaging (hereinafter referred to as the child protection packaging marking), as per item 1, Article 29, is as shown in Table 8.
  • ② The child protection packaging marking shall be applied before shipment for products manufactured in Korea, and before customs clearance for products manufactured overseas and imported into Korea.

01. How to place the markings for safety certification, safety confirmation reporting, supplier qualification, and child protection packaging.

B. How to place the marks
  • The sizes of the symbols of the safety certification, safety verification reporting, and child protection packaging (hereinafter referred to as the safety certifications, etc. shall be adjusted according to the size of the products subject to safety management. However, the ratio between the width and height of the marks are as shown in Paragraph A.
  • The safety certifications etc. must be placed on the products subject to safety management so that the marks are easily noticeable. These marks are also to be printed, engraved, or placed by other means to ensure that they do not fell off or get erased, etc.
  • The information on the marking method of the safety certifications, etc., information on safety standards, and other information as designated by the Head of KATS must be indicated in Korean. However, for electrical appliances, it is possible to make markings using Korean and alphabets, etc., in parallel.
  • The color of the safety certifications, etc. shall be, as a principle, black and maybe supplemented with other colors.
  • If it is difficult to make safety certification markings, or for the products that are purchased in bulk by the users without being resold into the market, it is allowed to make the markings on the smallest packaging unit of such a product, instead of every single piece of such a product.
  • The details of the markings and indications shall be in accordance with the announcement by the Head of KATS.
02. The indications of the exemption confirmation of the safety certifications, etc.
  • The exemption confirmation markings for the safety certifications etc. shall be placed on the surface of the eligible product.
  • The exemption confirmation markings of the safety certifications etc. shall be made using the symbols of safety certifications, etc., with a text 'Exemption Confirmed' beneath the symbol.
  • If it is not possible to place the exemption confirmation marks on the product because the product is for exportation, too small, or to be used as a part or a component, document the reason and attach the exemption confirmation slip on the related document, which shall then be preserved.
03. How to make the safety test marks of electrical appliances that are imported and previously owned.
  • The safety test marking of the imported, second-hand electrical appliances must be attached to the product itself.
  • The markings for safety testing of imported and second-hand electrical appliances shall be based on the symbols used for safety certifications, etc., and, in accordance with the procedures designated by the Head of KATS, a text that goes 'Safety Tested' and the unique identification number for the product must be indicated beneath the symbol.
